Introduction

Welcome to Regulars. Regulars is operated by Chaaropik LLC ("Regulars," "we," "us," or "our"). We provide a done-for-you customer comeback and retention service for restaurants. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our websites, contact us, use our Services, or receive communications sent through Regulars on behalf of a restaurant.

This policy distinguishes between information we handle for our own business purposes and restaurant guest information we process on behalf of our restaurant clients. If you are a restaurant guest, the restaurant's own privacy notice may also apply.

1. Information We Collect

We may collect the following types of information, depending on how you interact with us.

1.1 Personal Information

Identifiers and contact information: Name, email address, phone number, postal address, and similar identifiers.

Business information: Restaurant or company name, job title, business contact details, and information you provide about your business.

Payment and transaction information: Billing address, subscription details, invoices, and transaction records. Payment-card information is processed by our payment provider; we may not receive or store full card numbers.

Account and service information: Login or account details, service preferences, approved offers, campaign settings, support requests, and communications with us.

Restaurant guest information: Contact information, opt-in records, communication preferences, message history, campaign engagement, offer redemptions, and related information supplied by a restaurant or collected through restaurant-approved forms and touchpoints.

Communications consent records: The phone number or email submitted, consent status, date and time, source page or form, disclosure presented, and opt-out or revocation history.

Please do not provide sensitive personal information unless we specifically request it and it is necessary for the Services.

1.2 Device, Usage, and Similar Information

IP address, browser type, device type, operating system, approximate location derived from IP address, referring page, pages viewed, links clicked, and date and time of access.

Cookie identifiers, analytics events, and similar technical information used to operate, secure, and understand the Services.

Aggregated or deidentified information that cannot reasonably be linked to an individual.

1.3 Information from Other Sources

We may receive information from:

restaurant clients and their authorized systems;

service providers supporting hosting, forms, communications, analytics, scheduling, and payments;

social media platforms when you interact with our pages;

integrations you or a restaurant authorize; and

public sources and business directories, where permitted by law.

2. How We Use Your Information

We may use information to:

provide, configure, operate, support, and improve the Services;

create and deliver restaurant-approved email and text campaigns;

administer guest opt-ins, preferences, unsubscribe requests, and suppression lists;

communicate about inquiries, accounts, subscriptions, support, security, and service changes;

personalize content and measure campaign and website activity;

process payments and maintain business records;

protect the security and integrity of the Services, prevent fraud or abuse, and troubleshoot problems;

comply with law, enforce agreements, and establish or defend legal claims; and

market Regulars where permitted by law and consistent with your choices.

When we process restaurant guest information on behalf of a restaurant client, we use it to provide the Services under that restaurant's instructions and our agreement with the restaurant.

3. Cookies and Tracking Technologies

We and our service providers may use cookies, pixels, web beacons, local storage, and similar technologies to operate the website, remember settings, understand traffic and performance, and protect the Services.

You can manage cookies through your browser settings. Blocking cookies may cause parts of the Services to work differently. Where required, we will provide additional choices or obtain consent before using non-essential technologies.

4. Sharing of Information

We may disclose information in the following circumstances:

Restaurant clients: If you join or interact with a restaurant's program, we may provide that restaurant with information about your opt-in, communications, engagement, preferences, and tracked redemptions.

Service providers: We may provide information to vendors that support hosting, forms, communications, email delivery, analytics, scheduling, customer management, security, and payment processing. They may use the information only to perform services for us or as otherwise permitted by contract and law.

Professional advisers: We may disclose information to lawyers, accountants, insurers, auditors, and similar advisers where reasonably necessary.

Legal and safety purposes: We may disclose information to comply with law or legal process; protect rights, safety, and security; investigate fraud or abuse; or enforce our agreements.

Business transfers: Information may be disclosed or transferred in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of some or all of our business or assets.

With your direction or consent: We may disclose information when you direct us or give consent.

We do not sell personal information for money. As of the Last Revised date, we do not share personal information for cross-context behavioral advertising. If these practices change, we will update this policy and provide any legally required opt-out method.

5. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These measures may include access controls, secured service providers, and protections for information in transit or at rest where appropriate. No transmission or storage system is completely secure, and we cannot guarantee absolute security.

6. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain business and transaction records, honor opt-outs and suppression requests, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary according to the type of information, our relationship with you, client instructions, legal requirements, and operational needs.

We may retain limited information after a deletion request where necessary to document the request, honor an opt-out, detect fraud, comply with law, or establish or defend legal claims. Information may remain for a limited time in backups before deletion or isolation.

7. Your Rights and Choices

Depending on where you live and subject to legal exceptions, you may have rights to:

request access to or a copy of personal information;

request correction of inaccurate information;

request deletion of personal information;

obtain certain information in a portable format;

object to or restrict certain processing;

opt out of certain sales, sharing, targeted advertising, or profiling, if applicable;

limit certain uses of sensitive personal information, if applicable; and

receive equal service and pricing without unlawful discrimination for exercising a privacy right.

If your information was collected for a restaurant's program, please identify the restaurant in your request. We may forward the request to that restaurant or assist it in responding because the restaurant may control the information.

These rights apply only where the relevant law applies to Regulars and to the particular information. You may appeal a denied request where applicable by replying to our decision and stating that you wish to appeal.

8. Children's Privacy

The Services are intended for restaurants, adult business representatives, and general restaurant customers. They are not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child has provided us personal information, contact us so we can investigate and take appropriate action.

9. International and Cross-Border Data Transfers

Regulars is based in the United States. If you access the Services from another country, your information may be processed in the United States and other countries where we or our service providers operate. Those countries may have different data-protection laws.

Where applicable law requires a transfer mechanism or safeguard, we will use an appropriate mechanism. This statement does not mean that every privacy law applies to every interaction or that Regulars currently markets the Services in every jurisdiction.

10. Third-Party Links and Services

Our website and Services may link to or integrate with third-party websites, platforms, and services. Their privacy practices are governed by their own policies. We are not responsible for the privacy, security, or content of services we do not control.

11. Public Content

If you post information publicly on a social media page, review, testimonial, or other public forum, it may be seen, collected, and used by others. Do not post information you want to keep private.

12. Updates to This Policy

We may update this Privacy Policy from time to time. We will post the revised policy with a new "Last Revised" date. If a change materially affects how we use information already collected, we will provide additional notice or obtain consent where required by law.

13. Communications and Opt-Out Options

Marketing texts: Reply STOP to opt out. Message frequency may vary, and message and data rates may apply. You may receive a confirmation of your opt-out.

Marketing emails: Use the unsubscribe link in the email.

Marketing calls: Tell the caller that you want calls to stop or contact us using Section 15.

Restaurant communications: You may also contact the restaurant whose program sent the communication.

Cookies: Adjust your browser settings or use any cookie controls we make available.

Opting out of marketing does not prevent service, transactional, security, or legally required communications. Consent to receive marketing communications is not a condition of purchase.

14. United States State Privacy Disclosures

Some U.S. state privacy laws apply only to businesses that meet specific thresholds. If a law applies to Regulars and your information, we will honor the rights it provides.

The categories of personal information we may collect are described in Section 1. The business and commercial purposes for collecting and using that information are described in Section 2. The categories of recipients are described in Section 4. We do not sell personal information for money, and as of the Last Revised date we do not share personal information for cross-context behavioral advertising.

California residents may have rights to know, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive non-discriminatory treatment, where the California Consumer Privacy Act applies. The CCPA does not apply to every business. Nothing in this policy expands a law beyond its applicable scope.
